Disputes


Any dispute relating in any way to your visit or access of the Specter website or to the products or services you purchase through the Specter website shall be submitted to binding arbitration in Tallinn, Estonia.


Arbitration under these Terms of Use shall be conducted under the rules then prevailing of the International Arbitration Committee. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under these Terms of Use shall be joined to an arbitration involving any other party subject to these Terms of Use, whether through class arbitration proceedings or otherwise.



Indemnification


You agree to indemnify, defend and hold harmless Specter, its officers, directors, owners, partners, employees, agents, licensors, suppliers and any third party information provider to the website from and against all losses, expenses, damages and costs, including attorney's fees, resulting from any violation of these Conditions of Use (including negligent or wrongful conduct) by you or your use and access of the Specter website.



International Use


Given the global nature of the Internet, you agree to comply with all local rules including, without limitation, rules about the Internet, data, e-mail, privacy, copyright, and trademark infringement. Additionally, you agree to comply with all applicable laws regarding the transmission of technical data exported from the Estonia or the country in which you reside.

Specter's failure to insist upon or enforce strict performance of any provision of these Conditions of Use shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of these Conditions of Use. Specter may assign its rights and duties under these Conditions of Use to any party at any time without notice to you. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity or enforceability of any remaining condition. Specter Labs OÜ (“Specter,” “we”, “us” or “our”) developed our services to help you gain valuable business intelligence. We understand that privacy is important to both our online visitors and registered users. We respect your privacy and will take reasonable steps to protect your information as described in this Privacy Policy.


In the event of any inconsistency between our Terms & Conditions and this Privacy Policy, our Terms & Conditions prevail.


Specter is located at Ahtri 12, Tallinn 10151, Estonia. This Privacy Policy applies to the tryspecter.com website, including all subpages and successor pages (collectively referred to as the “Site”), and also applies to all software and services that we offer, including services that we offer through our Site when you register for a Specter account (collectively referred to as the “Services”).


This Privacy Policy does not apply to any website, product or service of any third-party company even if the third-party website links to (or is linked from) our Site. Specter does not operate or control those websites, products or services. Please always review the privacy practices of a company before deciding whether to provide any information. By using our Site or Services, you are accepting the practices described in this Policy.

When you register for an account, we collect Personal Information such as the following: Your name, company name, location, email address, phone number, and account password, to set up your account, Your IP addresses, devices, and locations used to access Specter, which will be linked to your account for fraud detection/prevention purposes.


Our Site and Services are directed to the general public. We do not knowingly collect Personal Information from children under 13 years of age.


We may use Personal Information in a manner that is consistent with this Privacy Policy for our legitimate business interests, including to respond to your inquiries and fulfill your requests, complete your transactions, provide you with customer service, send administrative information to you, and to personalize your experience on the Site and Services. We may also use Personal Information and other information collected through the Site or Services to help us improve the content and functionality of the Site and Services, to better understand our users and to improve the Site and Services.
